Il sagit des limites qui encadrent la publicit, au-del des obligations lgales, visant ce que le consommateur ne soit pas tromp, choqu, induit en erreur, ou incit reproduire des comportements nocifs, dangereux. Il existe des instances qui ont pour rle dappliquer ces principes et de sassurer de leur bonne excution.Plusieurs autorits sont comptentes pour rguler la publicit franaise. La premire et srement la plus importante sappelle lARPP (Autorit de Rgulation Professionnelle de la Publicit). Elle a pour mission de mener une action en faveur dune publicit loyale, vridique et saine, dans lintrt des consommateurs, du public et des professionnels de la publicit. Les contrles de lARPP se font autant avant la diffusion de la publicit quaprs.En France, les professionnels savent quil y a des rgles respecter quant la manire de faire une publicit. Ces rgles obissent une triple logique danticipation, de concertation et de responsabilisation. Nanmoins, ces rgles portent uniquement sur le contenu de la publicit, e t en aucun cas sur les questions relatives la promotion du produit ou service.Ce dwell pas le cas de toutes les autorits. En effet, le Conseil Paritaire de la Publicit (CPP), le Conseil de lthique Publicitaire (CEP) et le Comit de rdaction sont des instances associs lARPP qui gre toutes rglementations en amont (cest--dire avant la diffusion au public de la publicit)Le CEP agit principalement sur les problmes dordre thique que contiendraient une publicit.Le CPP, lui , sert dintermdiaire entre lARPP et les associations (qui ont des attentes face au contenu des publicits).Enfin, le Jury de Dontologie Publicitaire (JPD) contrle les publicits en aval, donc aprs leur diffusion. Il a pour mission de communiquer les plaintes fates lencontre de publicits et de campagnes drogeant aux rgles tablies.Pour finir, lARPP ne reoit aucune cover de la part de ltat elle est compltement indpendante.La deuxime instance comptente en matire de contrle publicitaire est connue il sagit du Conseil Suprie ur de lAudiovisuel (CSA)Cest un peu la police de la publicit (et plus gnralement de laudiovisuel). Il sassure du respect par tous les oprateurs des lois et de la rglementation de la communication audiovisuelle en vigueur. Il est en droit de sanctionner ceux qui sont en infraction contrairement lARPP qui na quun rle de contrle. Le CSA est une autorit administrative galement indpendante des pouvoirs publics.Dautres instances secondaires ou indirectes peuvent galement intervenir de temps autre face aux entreprises qui ne respecteraient pas les rglementations lgales obligatoires dans leurs publicits. (par exemple la heed gnrale de la concurrence, de la consommation et de la rpression des fraudes ou encore des associations charges de la protection des consommateurs).De nombreuses recommandations ont t crs concernant le domaine du dveloppement durable. La dernire a t valide le 18 juin 2009 par le Conseil dAdministration de lARPP il sagit des nouvelles rgles de dontologie publicitaire, qui ont t rcrites conformment lengagement pris dans la Charte pour une publicit co-responsable signe en avril 2008 avec les pouvoirs publics.Ces rgles se rsument en deux axes quand il y a une promesse relative au dveloppement durable ne pas induire le consommateur en erreur. dans tous les cas, ne pas reprsenter de comportements contraires aux principes communment admis du dveloppement durable. La premire hypothse est vrifie, comme on la vu ci-dessus, le secteur de la publicit est bel et bien rglementer. Pourtant, le Greenwashing est un phnomne bien prsent. On a galement constater que ces instances sont toutes indpendantes. On peut alors se demander si ces juridictions sont assez comptentes? Doivent-elles tre renforces par une intervention des pouvoirs publics afin de mieux surveiller les entreprises, et de stopper toute action de Greenwashing ? Doit-on crer une instance spcifique au dveloppement durable, pour grer ce phnomne?H2 Une intervention des pouvoirs publics est ncessaire po ur garantir le respect des rgles de la communication publicitaire. Dix ans aprs la signature du protocole de Kyoto en 1997 sest cr un grand ministre de lcologie, de lnergie, du Dveloppement durable et de lAmnagement du Territoire. Cette mme anne se droula le Grenelle de lEnvironnement (octobre 2007). Ces deux actions tmoignent de la volont des pouvoirs publics de faire de lenvironnement une priorit nationale.Lors dinterrogatoires, les Franais sont nombreux penser que ce nest ni aux citoyens, ni aux entreprises dagir et de prendre des mesures environnementales mais bel et bien aux pouvoirs publics de rglementer et dexercer un contrle sur leurs propres rglementations.Ltat franais a mis en place des actions de sensibilisation au dveloppement durable, et exige des rgles dontologiques ce sujet. Il se dit prt renforcer les contraintes et les obligations envers les entreprises, sans pargner le secteur de la communication.Le parlement europen est intervenu rcemment sur la question de lim pact du marketing et de la publicit (avec par exemple le lien entre la maigreur des mannequins et les comportements alimentaires des adolescentes). Cette thmatique pourrait aboutir davantage de rglementations, comme par exemple, un encadrement plus strict de lespace publicitaire (type affichage) ou encore laccs limage limit pour des produits polluants.Ltat doit donc rglementer davantage le secteur de la publicit tant au niveau national quau niveau europen.Nanmoins, il na pas pour rle de contrler ce domaine car des autorits telles que lARPP ou le CSA sont comptentes pour cette mission.De plus, louverture de lARPP aux associations devrait se traduire par une sensibilit accrue sur les questions environnementales et des pratiques mieux penses en amont. Si cela ntait pas le cas, une intervention rglementaire serait alors possible.Lhypothse H1 nest pas vrifie. Effectivement, ltat a pour rle dencadrer et de rglementer le secteur de la communication publicitaire mais cela doit se faire sa ns intervention de sa part car des instances sont l pour se charger de la bonne application de ces rgles. Nanmoins, il serait judicieux pour ces instances de crer un service spcifique, uniquement rserv aux publicits vertes, aux problmes de Greenwashing et plus largement au dveloppement durable. Nous avons vu que le secteur de la communication publicitaire tait rglement et contrl par des autorits comptentes et que les rgles lencontre de toute publicit verte mensongre staient multiplies depuis ces dernires annes afin de mieux surveiller toute enfreinte. On peut alors se demander quelles sont les consquences la non obissance de ces rgles pour les entreprises? Que risquent-elles?H3 Les entreprises qui pratiquent le Greenwashing sexposent de lourdes sanctions. Pour vrifier cette hypothse, il faut dabord se demander si le Greenwashing peut-tre qualifi de publicit mensongre. Selon la dfinition de la publicit mensongre, qui consiste cacher un lment du produit ou du service afin dattire r ladhsion de la clientle, le Greenwashing reprsente bel et bien une sorte de publicit mensongre (ou publicit trompeuse), car les entreprises font croire aux consommateurs potentiels ce quils ont envi dentendre.Le dlit de publicit mensongre est instantane (le caractre trompeur sapprcie ds le moment o la publicit est communique au public). Selon le dictionnaire permanent du Droit des Affaires, mme sil se manifeste lors de chaque communication au public, le dlit de publicit mensongre constitue une infraction unique qui ne peut tre poursuivie et sanctionne quune seule fois.Selon les articles L. 121-6 et L. 213-1, les infractions la rglementation sur la publicit mensongre sont passibles des sanctions suivantes amende pouvant aller jusqu 37 500 euros. emprisonnement dune dure maximum de deux ans.Les peines annonces peuvent tre cumulables ou non (selon la gravit du mensonge ou de la tromperie)De plus le maximum de lamende prvue ci-dessus peut-tre port 50% des dpenses de la publicit cons tituant le dlit. En cas de rcidive, les plafonds des amendes diffrent. (selon la clmence des magistrats).Le tribunal peut exiger de la part des parties ou de lannonceur la communication de documents utiles ou de justificatifs . En cas de refus, il est en droit de saisir ces documents, et peut prononcer des pnalits de retard allant jusqu 4 500 euros par jour compter de la date de demande des documents.En tout tat de cause, la sanction de la publicit mensongre ne peut pas tre assortie de linterdiction des droits civiques.Nanmoins, le ministre public, le juge dinstruction ou le tribunal saisi des poursuites peuvent tous les trois ordonner la cessation de la publicit cette mesure est excutoire nonobstant toutes voies de recours.Notre hypothse est vrifie des sanctions importantes sont appliques si les entreprises pratiquent de la publicit mensongre ou trompeuse. Pourtant, pour de puissantes entreprises, les montants des amendes ne reprsentent que trs peu, en tout cas pas assez pour les dissuader denfreindre la rglementation.On sait maintenant que les entreprises pratiquant le Greenwashing prennent des risques et sexposent des sanctions importantes. On peut alors se demander quels sont les risques du Greenwashing, pour les entreprises qui prennent de rels engagements environnementaux?H4 Le Greenwashing dcrdibilise le concept du dveloppement durable ainsi que les entreprises qui sengagent dans de relles d barrier environnementales. La tentation de pratiquer le Greenwashing est grande pour les entreprises elles rpondent aux attentes des consommateurs en communiquant sur ce quils veulent entendre qualit du produit, thique de lentreprise qui se dit irrprochable du point de vue social et environnemental. Comme on la vu ci-dessus, ces pratiques qualifies de verdissement frauduleux sont dangereuses pour les entreprises malhonntes.Mais le danger le plus inquitant se trouve au niveau du concept en lui-mme. En effet, en le manipulant, les entreprises frauduleuses le vident de sa substance, renforant ainsi la mfiance, voire la dfiance, des publics face linstitution.Certains consommateurs voient dj travers le concept du dveloppement durable une pure manipulation des entreprises pour se dculpabiliser et se blanchir tout en assurant leurs ventes. Cette manire de penser est trs inquitante quand on sait que certaines entreprises sont exemplaires dans leur politique environnementale, et que leur dmarche est plus que relle.Pour ces entreprises modles, le Greenwashing est dsastreux en terme dimage. Beaucoup de ces entreprises trouvent dangereux de vouloir communiquer tout prix sur leurs engagements pris en faveur du dveloppement durable. Cest pourquoi peu dentre elles communiquent ce sujet. Cest le cas des hypermarchs Cora, engags depuis le dbut des annes 90 dans une vritable politique en faveur du dveloppement durable. Lentreprise na jamais voulu communiquer ce sujet.Ces entreprises comme Cora, pensent que la confiance est perdue ds quil y a exagration ou arrogance elles limitent volontairement leur communication mme si pour beaucoup dentre elles, le dveloppement durable reprsente un acte fort de management.Pour certains annonceurs, parler denvironnement ne peut que faire du bien lenvironnement.Dans un sens, ils ont raison car grce cette mdiatisation, la plupart des Franais connaissent prsent le dveloppement durable et savent mme le dfinir correctement.Pourtant, si des entreprises communiquent sur leurs engagements de dveloppement durable, sans quaucune mesure ne soit prises en parallle, elles parlent bel et bien de respect de lenvironnement , tout en continuant le polluer autant quavant.De plus ce trop-plein dinformation prsente galement un ct pervers.Gnralement, ces informations sont donnes sans explication, sans mode demploi, hors contexte, de manire incomplte voire mme contradictoire. Cette vague dinformations outrance est contre- productive, et peut mme conduire un ras-le-bol gnral des discours cologiques.Face aux entre prises, qui, comme on la vu, ne communiquent que peu, il y a des entreprises, qui elles, au contraire, vont se venter de leurs produits respectueux, de leurs soucis environnementaux. En rsum, certaine communiquent outrance sur leurs faux engagements, tandis que dautres , honntes et engags, se tairont.Alors, qui ment? Qui dit la vrit? Qui se proccupe vraiment de la plante? Qui se donne une image de bon samaritain alors quil ne lest pas?Le Greenwashing sme le dsordre et le doute dans la tte des consommateurs. On peut alors se demander quelles sont les consquences du Greenwashing pour les consommateurs? Ont-ils conscience de ce phnomne vert frauduleux?H5 Le Greenwashing renforce la mfiance des consommateurs vis vis de lhonntet des entreprises. Certaines publicits vont lencontre du concept de dveloppement durable.Le phnomne de Greenwashing est loin dtre marginal. 64% des grandes entreprises dclarent mettre en avant souvent ou de temps en temps des arguments sociaux et environnementa ux dans leurs communications. Certaines entreprises se disent vertes alors que la nature mme de leur produit est en contradiction totale avec le respect de lenvironnement (exemple des entreprises automobiles, des laboratoires de produits chimiques ou encore des socits ptrolires).Ces pratiques ont des impacts certains, comme linstauration du doute et de la confusion sur ce qui est vraiment cologique et ce qui ne lest pas. Ces impacts, non ngligeables, vont lencontre du concept de dveloppement durable. On peut en rpertorier trois principauxlincitation lutilisation excessive de ressources et/ou dnergie. Les publicits nous encouragent au gchis. Par exemple, plusieurs marques de lessive encouragent les enfants se salir comme bon leur semblent, en insistant sur la facilit faire disparatre les tches. En tenant ce discours, ces publicits encouragent les personnes multiplier les cycles de lavage en machine et ne tiennent pas compte des impacts que cela peut avoir sur lenvironnement.le fait de dlaisser un produit au profit dun autre, plus fort impact ngatif sur la nature. Lexemple qui illustre le mieux cet impact est celui de la publicit de Cristalline en fvrier 2007, qui tenait le discours suivant Qui prtend que leau du robinet a toujours bon got, ne doit pas en boire souvent La marque nous incite consommer de leau en bouteille, alors que leau du robinet est dune grande qualit, des plus contrles et offre une meilleure quation environnementale que leau en bouteille. La ville de Paris et la socit de gestion des eaux parisiennes ont port plainte contre la marque.la banalisation ou le dni denjeux environnementaux. Ainsi, la marque Diesel sortit en 2007 une publicit montrant une gamme de vtements spcialement adapter au rchauffement du climat, et reprsentant cette adaptation , face au climat , joyeuse et facile.Le constat est alarmant en France, selon une tude effectue par lARPP et lADEME, sur les 17 129 visuels publicitaires analyss dans le cadre de ltude, 508 mess ages ont un lien avec lenvironnement.
